A trademark is a sign capable of distinguishing the goods or services of one enterprise from those of other enterprises.
The trademark rights are protected in India by the Trademarks Act, 1999. The Act was predominantly brought into force to fulfil India's international obligations after signing the TRIPS (Trade-Related Aspects of Intellectual Property Rights) agreement.
trademark protection can be obtained through registration, by filing an application for registration with the national/regional trademark office and paying the required fees.
